Starr Pennington, 42, was brought to Pawhuska Hospital by her boyfriend, Thomas Mongrain Eaves on August 25, 2015. Starr was covered in bruises and had been deceased for at least four hours, and was described as “ice cold.”

Thomas claimed Starr was an alcoholic and had been unresponsive for up to seven hours before he brought her in. He said he discovered her covered in vomit and not breathing, and that her injuries were due to his attempts to slap her awake. He also mentioned that she had fallen from his truck the previous week, breaking her ribs, and that her jaw had been broken earlier because she “would not shut up.” Thomas admitted knowing she was dead when he brought her in.

Thomas, who previously served 12 years in prison for murdering his father in 1986 and had a history of witness tampering in 2000, was charged with second-degree murder. The FBI investigated,since the crime occurred on Osage land, but a federal judge ruled that Thomas had been improperly detained without probable cause during the FBI interview. His arrest and statements were dismissed, leading to the charges being dropped. The Osage Nation also attempted to charge him, but the charges were dismissed because he was not provided an attorney in a timely manner.
